Terms of Use

By accessing or using the EDJ Online website at edjonline.com (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and EDJ Online. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

EDJ Online is an online marketplace that connects buyers and sellers of used industrial and commercial equipment. We provide a platform for listing, browsing, and inquiring about equipment. EDJ Online is not a party to any transaction between buyers and sellers and does not take possession of, inspect, or warrant any equipment listed on the Platform.

To post listings or contact sellers, you must register for an account. You must be at least 18 years of age and have the legal authority to enter into binding agreements. Account registration is subject to approval by EDJ Online at our sole discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at admin@edjonline.com if you suspect unauthorized access to your account.

When posting a listing, you agree that:

All listings are subject to review and approval by EDJ Online. We reserve the right to reject, remove, or modify any listing at our sole discretion without notice.

• You are the owner of the equipment or are authorized to sell it
• All information provided is accurate, complete, and not misleading
• Photos submitted are of the actual equipment being sold
• The equipment is legal to sell in your jurisdiction
• You will not list counterfeit, stolen, or prohibited items
• You will not post duplicate listings for the same item
• Pricing is stated in Canadian dollars unless otherwise specified

Buyers are solely responsible for evaluating equipment before purchase. EDJ Online does not inspect, certify, or warrant any equipment listed on the Platform. We strongly recommend that buyers:

• Conduct independent due diligence on the equipment and seller
• Inspect equipment in person or through a qualified third party before purchase
• Verify that the equipment meets applicable safety and regulatory standards
• Obtain appropriate insurance coverage

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Post false, misleading, or fraudulent listings or information
• Harass, threaten, or abuse other users
• Attempt to circumvent the Platform to conduct transactions off-platform in a way that deprives EDJ Online of its legitimate interests
• Scrape, crawl, or systematically extract data from the Platform without our written consent
• Introduce malware, viruses, or other harmful code
• Impersonate any person or entity
• Use automated tools to create accounts or post listings

EDJ Online facilitates connections between buyers and sellers but is not a party to any transaction. All negotiations, agreements, payments, and transfers of equipment occur directly between buyers and sellers. EDJ Online has no control over and makes no representations regarding the quality, safety, legality, or accuracy of any listing or the ability of sellers to sell or buyers to pay.

EDJ Online is not responsible for any disputes, losses, damages, or claims arising from transactions between users. Users are encouraged to resolve disputes directly and in good faith.

All content on the Platform created by EDJ Online — including the website design, logos, text, and software — is owned by or licensed to EDJ Online and protected by applicable intellectual property laws.

By submitting listing content (descriptions, photos, etc.), you grant EDJ Online a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. EDJ ONLINE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDJ ONLINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION CONDUCTED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

You agree to indemnify, defend, and hold harmless EDJ Online and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your listings, your transactions with other users, or your violation of these Terms.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

EDJ Online reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us. Termination does not affect any rights or obligations that arose prior to termination.

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
